How do I file a Request for Determination of Applicability (RDA)?
A Request for Determination of Applicability is used to determine if an area or proposed activity is subject to regulation under the Wetlands Protection Act or Hadley Wetlands Bylaw. To file an RDA, complete the following steps:
- Fill out WPA Form 1, found here: https://www.mass.gov/how-to/wpa-form-1-request-for-determination-of-applicability and send it to both conservation@hadleyma.gov and the DEP at wero_noi@mass.gov. Submit whatever sketches, plans, and documentation you have with the application. A copy of the permit application should also be delivered by hand (refer to office hours, or leave it in the mailbox on first floor) or mailed to the Conservation Commission Office at 100 Middle Street. There is a filing fee for RDAs paid to the town (cash or check) which you can send to Town Hall at 100 Middle Street. See the Conservation Commission filing fee schedule in the left-hand menu.
- Submit a legal notice to the Daily Hampshire Gazette. Use our legal notice template in the left-hand menu and fill out the highlighted portions, then send it to legals@gazette.net. This must be posted at least 5 business days ahead of the meeting.
- Once you submit the application we will schedule a site visit.
- Once that’s all complete you will be placed on the next Conservation Commission agenda where the Commission will make a determination on your project.
